This article is not quite correct. most homebrew software may be compiled with any compiler, the xdk is no help here as the signed binaries it creates still require a developer xbox else they do not run and whoever owns a developer xbox can legaly use the xdk.
to run unsigned code what is needed is a modchip or a hoebrew firmware patch to allow unsigned code to run, and thats the much easier solution. there is currently no way(hack) to the key used on retail consoles to self sign applications. but people are running a bruteforce attack to get this key.

So, it is legal to write something, compile it, and put it on the internet? How in the wide world can anyone prevent you from doing that?
Actually, most homebrew software is dependent on library files found within the XDK. And the XDK doesn't help with the key, just to create the actual programs.
Not everyone who owns a developer xbox can legally use the XDK, since a Retail Xbox can be moddified with a modchip and a few new RAM pieces to make it a developer Xbox, complete with the XDK Debug BIOS.
And the point is not to just run unsigned code, but to create it.

Wouldn't it be a good idea to explain where you get the XDK, who you talk to at Microsoft about XBox development, how one might go about getting code signed, and what all this code signing is about (specific to the XBox). This is pretty complex, and the Internet is extremely silent on these issues. I'd add it myself, except that I haven't been able to get straight answers yet. Out of date
The article appears fairly old and doesn't mention the differences between Xbox and Xbox 360. This is important as it's not clear which one(s) this article applies to, especially the hardware specs at the bottom of the article. Anyone have an idea how to find the new info?
