Kenneth Frank Eichner (born 1954) is an American trial lawyer. Eichner worked in Maryland as a prosecutor and a defense attorney before opening his own firm in Denver. Eichner has tried a number of high-profile cases.

Early life and education

Eichner was born in July 29, 1954 into a family of Russian-Jewish descent. His father, Sidney Eichner was a businessman who operated a furniture company and served in the Army Air Corps during World War II.

Eichner attended Bethesda-Chevy Chase High School. He then studied English at the University of Wisconsin-Madison before completing an undergraduate degree at North Carolina State University in art history and design. He went on to study at Antioch School of Law where he was editor of the Law Review.

Eichner interned with the D.C. Court of Appeals for Judge James A. Belson.[1] He also won a Department of Justice scholarship to clerk with the homicide division of the U.S. Attorney's Office.

Career

Overview

After graduatng, Eichner clerked for William C. McCullough, the chief district court judge of Prince George's County, Maryland.

Eichner began his career as a prosecutor.

In 1996, he launched The Eichner Law Firm, based in Denver, Colorado.

High profile cases

Eichner has tried a number of high-profile cases.

  • As a prosecutor, Eichner successfully prosecuted Warren E. Graham, a 17-year-old boy that shot a high school teacher[2] in a trial that drew the attention of Bill Clinton on the issue of school violence.
  • While serving as a prosecutor in Prince George's County, Eichner prosecuted Warren E. Graham in 1994 in connection with the shooting of a teacher at Largo High School. The Washington Post reported on Eichner's role in the prosecution, including arguments he made during the proceedings and his comments following the verdict.[3][2]
  • As a defense attorney, Eichner defended Carol Elkins, a nurse charged with murder. Though she faced life in prison, Elkins was eventually sentenced to house arrest.[4]
  • After a six-year Department of Justice investigation into insurance fraud, Eichner won a six-week federal jury trial on behalf of Daniel John Travers, who was falsely accused of mail fraud.[5]
  • In 1998, Eichner won a federal trial in which Jon Williams was accused of playing a bomb making role in a national drug conspiracy network. Williams was acquitted of all charges and all the other co-defendants were sentenced to life.[6]
  • In 2016, Eichner represented Canadian citizen Colby Messer who was charged with six counts of sexual assault in Denver, Colorado. Mr. Messer and three other Canadians faced life imprisonment, and the entire case was dismissed after a two-day preliminary hearing, which was covered by NBC and every major media outlet in Canada.[7][8]
  • Eichner, along with Michael Delcour, also represented presidential candidate Hillary Clinton's technology service provider in connection with federal and congressional investigations in Colorado and Washington, D.C.
  • During the 2018 Congressional Hearing of Supreme Court Justice nominee Brett Kavanaugh and subsequent FBI inquiry, Eichner represented witness Timothy Gaudette (referred to as “Timmy” on Justice Kavanaugh's calendar exhibit).[9]
  • In 2019, Eichner was awarded the largest verdict in Colorado history for defamation and malicious prosecution: $2.7 million in Weld County, Colorado.[10]
  • In 2022, Eichner assisted a national law firm in defending Pilgrim’s Pride Corp in a shareholder derivative suit for price-fixing allegations in Weld County, Colorado. Also assisted in parallel federal criminal anti-trust case brought by the U.S. Department of Justice resulting in acquittal.[11]
  • Eichner represented Timothy Gaudette during the Congressional inquiry of Supreme Court Justice nominee and the subsequent interview process by the Federal Bureau of Investigation.[12] Eichner also represented presidential candidate Hillary Clinton's server company, Platte River Networks,[13] in the Federal Bureau of Investigation and Department of Justice National Security Division's inquiry into the handling of classified information.[14][15]
  • In 2016, Eichner represented Canadian citizen Colby Messer, who was charged with sexual assault in Denver. The charges were dismissed following a preliminary hearing.[16][17]
  • In 2019, Eichner represented the plaintiff in a Weld County, Colorado, defamation and malicious-prosecution case that resulted in a $2.7 million jury verdict.[10]

Other notable defenses include infamous serial killer Scott Lee Kimball,[18] and Don Dewitt Smith, who was cleared of a vicious assault.[19]

Eichner also volunteers in LYRIC (Learn Your Rights in the Community), a social justice platform that teaches teens about their constitutional rights.

Awards

Eichner was the recipient of the Maryland Governor's Citation, Senate and House of Delegates Resolutions for Outstanding Achievement as a Prosecutor.[20]

In 2017, Eichner's successes with the Messer and Clinton cases led to his nomination for the Denver Bar Association's Award of Merit, which recognizes attorneys for outstanding contributions and services rendered in the administration of justice.

Personal life

Eichner is married to wife, Janjuree and the couple have one daughter.

Eichner has also served as an associate producer of the short film Fine Food, Fine Pastries, Open 6 to 9.
